A Notice for those who were on Light Duty/Modified Workers’ Compensation and laid off due to COVID-19

April 17, 2020

By Shelley W. Elovitz, Esquire

If you were on light duty or modified duty due to a Workers’ Compensation injury and laid off because of COVID-19, the Workers’ Compensation carriers are telling us that they will not voluntarily reinstate weekly Workers’ Compensation benefits. Therefore, anyone who was on Workers’ Compensation and laid off must contact us so we can determine:

  • Whether or not a petition for reinstatement must be filed ASAP or
  • Whether the worker should be filing for Unemployment Compensation under the current programs.

Each case is different and therefore must be analyzed separately and quickly. In some cases, we may advise to file for both Unemployment Compensation and Workers’ Compensation. Contact one of our Workers’ Compensation attorneys, contact us online or call (412) 338-1114.
