Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) can avoid expensive litigation

Litigation is time consuming, distracting, difficult, and costly for plaintiffs and defendants alike. For these reasons, Alternative Dispute Resolution (ADR) has steadily gained acceptance and popularity. Arbitration and mediation are two of the most widely accepted ADR techniques and Rothman Gordon is proud to have seasoned mediators, arbitrators, and early neutral evaluators ready to assist you.

Mediation

Our attorneys have mediated a wide range of civil cases, including class actions and multiple party cases, and commercial cases such as franchise, contract, shareholder, real estate, and breach of warranty disputes. (Want an honest assessment of our mediation capabilities? Please see below.) We also offer Virtual Mediation.

We also have extensive experience in labor and employment mediation and arbitration, including sexual harassment, discrimination, wrongful termination, FLSA, and other employment issues.

We practice family law mediation to achieve fair settlements for all parties in custody, relocation, equitable distribution, and protection from abuse cases.

Video Conferencing & Virtual Mediation

Currently, travel is difficult and social distancing is still being strongly encouraged. Therefore, the mediators at Rothman Gordon are pleased to offer the option of Virtual Mediation.

Using the Zoom platform, our mediators can interact with all parties, regardless of their locations. Using the breakout room feature, parties can have a private space for discussion. Screen sharing enables parties to share relevant documents and graphics.

Having already conducted virtual mediations, our mediators can guide you through the process. We offer a pre-mediation run through for counsel so you can feel comfortable coming into the scheduled mediation.

Please contact us with any questions you have about the process.

What Attorneys have to say about Rothman Gordon mediations

“Mediation with Mr. Kushner went off without a hitch.  The fact that it was via video conference did not make a difference (in fact it was convenient) and he did a great job handling the matter, which was no surprise.”
– Chris Gabriel, Esq. Cafardi Ferguson Wyrick Weis + Gabriel, LLC

“Lou is fantastic, sophisticated, and has so much experience as a lawyer and mediator. He has instant credibility with both parties and with clients. He really takes time in advance of the mediation to understand the key and critical issues so that he is able to address them almost immediately into the mediation and effectively interact with both parties.”
– Sara Begley, Esq., Holland & Knight

“Steve recently served as mediator in two of my employment cases, each of which presented their own challenging issues. I believe Steve’s hard work throughout the mediation and years of experience in the field significantly contributed to the successful resolution of both cases. Seamlessly, Steve was able to handle both mediations via video conference, allowing the parties to resolve their disputes effectively and without delay in the midst of the COVID-19 pandemic.

Steve is always thoroughly prepared and has an understanding of the legal and factual issues presented. More importantly, he is thoughtful, expresses great concern for the individuals whose cases are being considered and takes the time to develop a rapport with each individual. These traits allow Steve to easily gain an employee’s trust, thereby creating value and weight to his assessments. My clients felt heard, and were satisfied with the result. I would not hesitate in recommending Steve to anyone seeking mediator to handle an employment dispute.”
– Stephanie Solomon, Esq., HKM Employment Attorneys, LLP

“We completed a virtual mediation with Louis Kushner. The process was easy, convenient, and allowed us to effectively resolve our case. I would definitely recommend it and Louis!”
– Stephanie Fera, Esq., Cafardi Ferguson Wyrick Weis + Gabriel, LLC

“Lou helped us settle a high-exposure and complicated matter with ease and grace. He was thorough, knowledgeable, and easy to work with. Whether via Zoom or in person, I have full confidence in his ability to help resolve difficult issues and keep all parties satisfied with the experience and the results.”
– Dana Feinstein, Esq.,  Holland & Knight
