Our attorneys understand that navigating the labyrinth of environmental laws, regulations and guidance can often be intimidating, confusing and challenging (particularly for clients who have little or no experience dealing with environmental issues or with government agencies).  Our attorneys use their technical knowledge, years of experience and relationships with a vast network of environmental professionals and consultants to help clients overcome these complexities (often without the need for expensive or protracted litigation).  However, that certainly does not mean that our attorneys object to pursuing litigation where necessary – our attorneys have won hard fought victories for clients in civil and criminal environmental actions filed in federal and state courts throughout the country and have successfully challenged overzealous actions by federal and state agencies before countless federal and state administrative tribunals.

Our experience includes:

  • Representing a large metals processing company in negotiating the terms of a new National Pollutant Discharge Elimination System Permit to recycle waste at a wastewater treatment plant.
  • Advising a chemical manufacturer with the development of remedial actions to “clean up” a contaminated site which was listed by the EPA on the National Priorities List.
  • Representation of a large coal company in a state court action to enforce its rights to access surface property for the purpose of conducting exploratory mining activities.
  • Advising dredging companies in securing necessary permits from the U.S. Army Corps of Engineers and the PA Department of Environmental Protection.
  • Assist clients with securing necessary permits to open and conduct coal and non-coal mining operations throughout Pennsylvania.
  • Successfully defended numerous claims against underground mine operators who were alleged to have caused subsidence damage to property and/or structures or water supplies.
  • Representing a client in injunction actions to enforce its rights to make reasonable use of overlying surface to further its coal mining operations. Matters involved filing for preliminary injunctive relief which resulted in client successfully obtaining access to properties in accordance with its mining rights.
